Conditions of Sale

  1. This quotation is current only for the period stated on the order.

  2. The prices in this quotation are based on the running costs of labour, services and materials as at the date hereon.

  3. Changes in the specifications, quantities, schedule or other aspects of the services that are requested or approved by you do not become binding upon Gromac Quarries unless accepted by Gromac Quarries in writing. Any such changes may result in additional or increased charges, and you agree to pay such increased charges.

  4. Gromac Quarries has the right to vary the quote price and may pass on any increase in price arising from:

    I. variations to the Modern Quarry Award or Employment Agreements

    II. by an amount of variation in the cartage schedule cartage rate, attributable to any abnormal increase in operating cost, such as fuel.

  5. The delivery of quarry products is based on full load capacity of the delivery vehicle.  If a smaller tonnage is required the delivery price will be based on a full load.

  6. The delivery price is based on the quickest possible route to the delivery site, as at the date of the quote.  If that access if prohibited and a longer route has to be taken, Gromac Quarries reserves the right to pass on any additional costs incurred 

  7. Gromac Quarries will apply discretion when providing orders on credit.  Goods and/or services provided on credit will be subject to the terms and conditions set out within the Credit Application Form.  Invoices must be paid in full by the due date shown on the invoice.  Prices quoted are on a GST exclusive basis.  Customers who do not hold an account with Gromac Quarries will be required to arrange payment prior to the discharge of goods. 

  8. All works such as blending and deliveries are to be carried out in normal working hours.  Work outside these hours will incur an additional cost.  Gromac Quarries reserves the right to refuse any variation to working normal hours.

  9.  It is the responsibly of the Customer to provide a safe workplace and tipping area.  The Customer agrees to indemnify Gromac Quarries, its drivers and contractors from any losses, costs or expenses incurred as a result of the failure to provide safe access.  For example, damage to private and public property and for all injuries to any person that may occur.

  10. The Customer also indemnify Gromac Quarries, its drivers and contractors from any losses, costs or expenses in relation to any walls, kerbing, guttering, roadways, footpaths, paving, plumbing, drainage or any buildings, or other property situated in or adjacent to the place of delivery. 

  11. Site inductions up to a half an hour for each operator will be allowed for by Gromac Quarries.  Over this allowed time, a charge of $90.00 will occur for each operator.

  12. All deliveries are based on a tip and go arrangement.  If the delivery truck is delayed on site for any reason other than a breakdown, for more than 10 minutes, Gromac Quarries reserves the right to charge for waiting time, at the standard hourly rate of $120.00 per hour + GST for Body Trucks, $170.00per hour + GST for Semi Tippers/Truck & Dogs,$220.00 per hour + GST for B Double Tippers,$280.00 per hour + GST for Double Road Trains and $330.00 per hour + GST for Triple Road Trains.

  13. All Pugmill loadings are based on the continuity of trucks and pugmill engagement. Pugmill Engagement charges apply to Pro rata hours when the pugmill is engaged for less than 4 hours. Pugmill waiting time charges apply for delays in excess of 30 minutes. Gromac Quarries reserves the right to charge for pugmill engagement and waiting time, at the hourly rate of $250.00 per hour +GST

  14. The delivery driver is not bound to tip the load if he/she feels the site is unsafe.   In the event the load cannot be delivered and has to be returned to the quarry, Gromac Quarries reserves the right to charge for delivery costs incurred. 

  15. The Customer or its representative must be present at the time of delivery, and sign the delivery docket to acknowledge the product and quantities described on the docket have been delivered.  Where the Customer or its representative are not available to sign the docket, then the signature of the delivery truck driver shall be prima facie evidence of delivery of the product ordered and delivered.

  16. Where the Customer or its representative is not on site to direct the truck driver, a tipping area must be clearly marked.  Gromac Quarries, its drivers and contractors, will not be responsible where a Customer fails to provide adequate delivery instructions. Any cost to remove the material is the responsibly of the Customer.

  17. Gromac Quarries will not be liable for any loss arising from the delay, non-delivery or non-supply of goods. 

  18. The Customer is responsible for ensuring the safe use and control of any associated hazards with Quarry products. Hazard information can be found on the Quarry Products Safety Data Sheet (SDS).

  19. Any claim relating to any alleged deficiency in goods delivered, must be lodge within 24 hours of delivery.

  20. Until payment of all monies is received, goods delivered remain the property of Gromac Quarries.
